33起“医闹”犯罪案件的分析与思考

Research on 33 cases of medical disturbance crime

目的:探索针对性措施,预防“医闹”犯罪发生。方法:中国裁判文书官方网站搜索关键词“医闹”和刑事案件,共获得2012—2019年“医闹”犯罪裁判文书33份。把33份裁判文书数据录入Excel2007进行统计分析。结果:33起“医闹”犯罪案件共造成物品损失116878元,25人轻微伤、5人轻伤和1重伤,涉及32家医疗机构和1家医疗主管部门、4项罪名、122名罪犯、16类犯罪点和30类主要犯罪行为。结论:犯罪数据在每组中各有特点,聚众扰乱社会秩序案件比例高,地点主要集中在病房、门诊大厅、医院大门口。

Objective:To explored targeted measures to prevent the occurrence of crime of medical disturbance.Methods:The criminal cases of medical disturbance from 2012 to 2019 were collected from the official website of China Judicial Documents.A total of 33 copies of judgment documents were obtained by search of keywords of Medical Dsturbance and Criminal Case.The relevant data of the cases was inputed to Excel 2007 for statistical analysis.Results:The above 33 crimes resulted in 25 light bodily juries、5 minor injuries and 1 serious injury.They also involved property loss of 116,878 yuan、32 medical institutions and 1 health authority、4 kinds of crime、122 crminials、16 crime locations and 30 major crimes.Conclusions:The crime data has own characteristics in each of categories.The proportion of disturbance of social order was very high in all criminals.The majority of crimes took place in ward、outpatient hall and gate.
