中医医院改革与发展法律问题探析

Analysis of legal issues in the reform and development of TCM hospitals

目的:探析中医医院改革中的法律问题并提出对策。方法:结合中医医院改革与发展任务、目标和具体实践,分析其中的法律问题,并从国家立法、政策制定、医院管理等层面提出改进建议。结果:中医医院改革与发展中的法律问题主要包括中医医院的机构职能定位、中医师的执业范围、中医“医疗”与“保健”的法定界限以及中医药知识产权保护等方面。结论:应从完善立法、精准制定政策和加强中医医院自身法治建设能力等方面,为中医医院综合改革提供法律保障。

Objective:To explore the legal problems in the reform of TCM hospitals and put forward countermeasures.Methods:The legal problems highlighted in the reform and development of TCM hospitals in China were analyzed,and suggestions for improvement were put forward from the aspects of national legislation,policy making and hospital management.Results:The legal problems in the reform and development of TCM hospitals were as follows:the institutional function of TCM hospitals,the scope of TCM doctors’ practice,the legal boundary between TCM ‘medical treatment’ and ‘health care’,and the protection of intellectual property rights of TCM.Conclusion:The relevant achievements of comprehensive reform of TCM hospitals should be guaranteed from three aspects perfecting legislation,making accurate policies and strengthening the legal construction ability of TCM hospitals.
