摘要 食品安全职业打假人是职业打假人的主体部分之一,其把向市场监管部门投诉举报作为其买假索赔的一种手段。这一恶意投诉举报行为扰乱了市场秩序、消耗了行政执法资源和司法资源。当前,应当通过完善投诉举报制度提高食品安全执法水平,需统一司法裁判尺度和标准,妥善处理职业打假人的正当投诉举报作为,严厉打击恶意投诉举报,保障食品安全投诉举报在法治轨道上运行。 The Food Safety Law improves the standard for punitive damages and the Supreme People's Court judicial interpretation recognizes the legal status of food and drug counterfeiting professionals,attracting many professional counterfeiters into the food safety field.Professional counterfeiters use complaints and reports to market supervision departments to"buy fake claims",which disrupts the market order and wastes administrative enforcement and judicial resources.At present,it is important to improve the complaint reporting system,enhance the level of food safety supervision and enforcement,unify the scale and standards of judicial adjudication,properly handle legitimate complaints and reports from professional counterfeiters,and crackdown on malicious complaints and reports.As a result,it can make food safety complaints and reports operate within the rule of law.
