摘要
居家养老服务的法治化是目前我国亟待解决的焦点问题。文章通过归纳总结我国近年来在探索适宜我国发展的养老模式的过程中逐步确立的以居家养老为核心的养老服务体系,得出居家养老服务开展的政策分散性、规范碎片化以及法律制度的缺位已严重影响到居家养老服务的良性发展的结论。发展我国居家养老服务,应当坚持立法先行,明确立法理念,再逐步完善多元化监管法律制度、资金保障法律制度,并在确保能够长期持续发展的前提下,进一步完善居家养老服务法律制度。
The legalization of home-based elderly care services has become a focal issue that needs to be solved urgently in our country.By summarizing the elderly care service system with home care as the core that has been gradually established in the process of exploring suitable elderly care models for my country's development in recent years,the article concludes that the policies for home care services are decentralized,standardized and fragmented,as well as the lack of legal systems,this conclusion has seriously affected the healthy development of home-based elderly care services.To develop home-based elderly care services in my country,we should adhere to legislation first,clarify the legislative concept,and then gradually improve the legal system for diversified supervision and financial security,and further improve the legal system for homebased elderly care services on the premise of ensuring long-term sustainable development.
