Protection Strategy for Chinese Trademarks in Ten countries of ASEAN under RCEP Agreement

2022年1月1日,RCEP协议生效,为我国企业开拓东盟十国市场创造了更加有利的条件。在该协议下,我国企业在东盟十国的商标保护面临着新的问题和挑战。虽然我国企业在东盟十国的商标注册总数在世界各国排名较前,但利用马德里体系指定生效的商标数不容乐观;商标后期保护状况堪忧,失效商标和效力待定商标较多,而且商标抢注现象严重。在东盟十国,我国企业应该更加重视利用马德里体系指定商标生效并注意商标的后期维护;积极应对驰名商标的侵权抢注;政府也应该加强对企业商标海外保护的先期培训和指导,帮助企业利用商标海外维权机制开展事后救济和帮扶。

On January 1st,2022,the taking effective of RCEP has created more favorable conditions for Chinese enterprises to open up the market of the ten ASEAN countries.Under the RCEP agreement,Chinese enterprises in the ten ASEAN countries face new problems and challenges in trademark protection:On the one hand,Chinese enterprises rank among the top countries in the world in the total number of trademark s registered in the ten ASEAN countries,on the other hand,the number of effective trademarks designated by Chinese enterprises using the Madrid trademark system is not optimistic,the protection of Chinese trademarks in the after-registration stage in ASEAN is not good,and there are many inactive trademarks and pending trademarks,and serious issue of trademark registered by others in advance.Enterprises should pay more attention to the effective registration of trademarks in the ten ASEAN countries by using the Madrid system,and pay attention to the maintenance of registered trademarks,and actively respond to the well-known trademark infringement;The government should pay attention to the training and guidance on the overseas trademark protection,and establish the overseas trademark protection mechanism to help the enterprises to carry out the ex-post relief.
