公共安全理论视域下反恐怖主义地方立法模式的确立与架构

Establishment and Structure of Anti-terrorism Local Legislation Model under the View of Public Security Theory

公共安全理论认为恐怖主义活动作为一种社会越轨行为是人类社会发展中不可避免的伴生物,维护公共安全就必须对这种社会越轨行为进行预防和控制,而科学立法是实现预防控制的前提与基础。基于我国单一制下不同行政区划反恐怖主义面临态势的差异,需要在公共安全系统论指导下确立反恐怖与反极端、反恐怖与反分裂、反恐怖与反渗透等各具特色的地方融合立法模式,并从地方重点地域立法推进、重点立法内容架构和特色立法内容彰显等方面架构反恐怖主义地方立法框架,实现对恐怖主义活动的全方位防范和控制。

According to the theory of public security, terrorist activities, as a kind of social deviant behavior, is an inevitable companion in the development of human society.It is necessary to prevent and control this kind of social deviant behavior in order to safeguard public security, and scientific legislation is the premise and foundation of realizing prevention and control.Based on the different situation of anti-terrorism in different administrative districts under the unitary system in China, it is necessary to establish the local integrated legislative mode of anti-terrorism and anti-extremism, anti-terrorism and anti-division, anti-terrorism and anti-infiltration under the guidance of the theory of public security system.In order to prevent and control the terrorist activities, the framework of local anti-terrorism legislation should be set up from the aspects of local key regional legislation, key legislation architecture and characteristic legislation architecture.
