《民法典》视野下探望权属性探析

An Analysis of the Visitation Right Attribute from the Perspective of China’s Civil Code

《民法典》实施以来,探望权作为婚姻家庭编中调整亲子关系的重要权利备受瞩目。目前正值我国《民法典》实施之初,探望权制度的实施与发展是保护非常态婚姻家庭状态下亲子关系的重要法律制度。探究探望权的属性对探望权制度的发展具有不容小觑的理论价值。立足于民事权利的理论基础,重新审视探望权的概念及其特征,阐释探望权在我国民事权利体系中的地位,辨明探望权与亲权、探望权与监护权的关系并揭示出探望权的权利属性,以期较为全面地展现出探望权设立的理论根基。

Since the implementation of China’s Civil Code,the visitation right that is an important right to adjust parent-child relationship in the Marriage and Family Book has attracted much attention.At the beginning of the implementation of China’s Civil Code,the implementation and development of the visitation right system is an important legal system to protect the parent-child relationship under the nonnormal marriage and family.Exploring the nature of the visitation right has theoretical value on the visitation right legislation that cannot be underestimated.This paper tries to stand on the open perspective of China’s Civil Code and base on the civil rights theoretical basis,to re-examine the concept and the characteristics of the visitation right,analyze the status of the visitation right in China's civil rights system,discern the relationship between the visitation right and the parental right as well as between the visitation right and the guardianship,and also discriminate the attribute right of our visitation right.It attempts to fully demonstrate theoretical foundation on the establishment of the visitation right system in China.
