摘要
伴随互联网、人工智能、云计算等新型技术的蓬勃发展,数字经济迸发出强大的生命力,成为新时代的重要特征。然而由于数字经济具有虚拟性、隐蔽性等特征,给消费者造成的损害更加具有普遍性和公共性。如数字经济背景下普遍存在的大数据杀熟、平台“封禁”、平台“二选一”等不正当竞争行为侵害消费者个人信息、自由选择权、公平交易权等权益,这使得保护消费者权益的呼声日益增高。数字经济时代下消费者权益保护无论是在市场经济体系的建立还是法律体系的完善上都存在很多问题亟须解决,面对新环境、新形势,需要协调法律制度、政府监管、行业自律等多方面因素统筹推进。
With the vigorous development of new technologies such as the Internet, artificial intelligence and cloud computing, the digital economy has directly burst into strong vitality and become an important feature of the new era. However, due to the characteristics of digital economy such as virtuality and concealment, the damage to consumers is more universal and public. For example, in the context of digital economy, unfair competition such as big data killing, platform "ban" and platform "choose one from two" infringes on consumers’ rights and interests such as personal information, free choice and fair trade, which makes the voice of protecting consumers’ rights and interests increasingly high. In the era of digital economy, there are many problems in the protection of consumer rights and interests, whether in the establishment of market economy system or the improvement of legal system, which need to be urgently solved. Facing the new environment and new situation, it is necessary to coordinate the legal system, government supervision, industry self-discipline and other aspects to promote overall planning.
