论应得违法收入越位的扩张效应及其解释思路

On the expansion effect of offside deserved illegal income and its explanation

我国刑法规范中的违法收入、应得违法收入、可得违法收入与数额犯中的数额没有实质性差异。数额犯中的数额在不同场合有不同的功能,但本质上属于构成要件要素中的结果。按照数额犯结果危险程度划分,取得型数额犯的既遂、未遂、预备形态分别对应已得违法收入、应得违法收入、可得违法收入。在犯罪形态上,将应得违法收入越位评价为既遂形态,会扩大数额基本犯与数额加重犯的处罚范围。对应得违法收入的解释,应以结果危险为标准,在不同类型的危险犯与结果犯中,贯彻层级解释思路。

There is no substantial difference among illegal income,deserved illegal income,available illegal income and the amount of crime in China′s criminal law.The amount in the amount crime has different functions on different occasions,but it is essentially the result of the constituent elements.Divided according to the risk degreeof the outcome of the amount crime,the completed,attempted,and prepared forms of the amount of the amount crime correspond to the illegal income earned,the illegal income deserved,and the illegal income available.Regarding the form of crime,evaluating offside due illegal income as an accomplished form will expand the scope of punishment for basic amount crimes and aggravated amount crimes.The interpretation of the deserved illegal income should be based on the result risk,and the level of interpretation should be implemented in different types of dangerous offenses and consequent offenses.
