预审作为重要的前置审查监督程序是连接侦查与起诉的关键环节,其在确定案件性质、获取口供、审查判断证据、深挖扩线等方面具有重要作用。但是纵观预审制度的发展历程,无论作为独立的预审制度还是将预审寓于侦查之中都影响着整个刑事诉讼程序的进程和效益,究竟是确立独立的预审程序(预审制度)还是融预审于侦查之中更符合时代正义的主旨内涵、更能体现法治精神、更贴合风险导向预审之本意,这需要因情势分而论之以及对预审进行综合审视,但重点在于对预审本身深入剖析,对其程序合理区分、功能恰当定位、风险正确识别与控制,从而降低或消除影响预审效能的风险因素才是保证刑事诉讼公正合理的侧面。

As an important pre-examination review and supervision procedure,pre-trial is a key link connecting investigation and prosecution.It plays an important role in determining the nature of the case,obtaining confessions,reviewing and judging evidence,digging and expanding lines,etc.However,throughout the development process of the pre-trial system,whether as an independent pre-trial system or putting pre-trial in investigation affects the process and efficiency of the whole criminal procedure.Whether to establish an independent pre-trial procedure(pre-trial system)or integrate pre-trial into investigation is more in line with the main connotation of the justice of the times and can better reflect the spirit of the rule of law More in line with the original intention of risk-oriented pre-trial,which requires a comprehensive review of the pre-trial according to the situation,but the focus is on the in-depth analysis of the pre-trial itself,the reasonable distinction of its procedures,the appropriate positioning of its functions,the correct identification and control of risks,so as to reduce or eliminate the risk factors affecting the pre-trial efficiency,which is the side to ensure the fairness and rationality of criminal proceedings.
