Characteristics and Countermeasures of the New Retail Illegal Fund-raising Crime

新零售作为第五次零售业革命产物,近年来在我国得到长足发展,但其存在法律体系不健全、行业监管不到位、社会信息不对称等灰色地带,部分利用新业态、新零售开展非法金融活动的行为严重妨害国家经济发展与社会稳定。新零售非法集资犯罪呈现经营核心数字化、犯罪链条复合化、主体迭代快速化、商品服务道具化、组织发展传销化、资金流转隐性化的特点,案件模式新、认定难,数据大、取证难,人员杂、维稳难,给公安机关经侦部门带来新挑战。基于实战案例解析与《防范和处置非法集资条例》,研究新零售非法集资犯罪特点与侦防对策,建立预警监测机制,对于公安机关打防并重、构建综合治理格局具有重要意义。

As a product of the fifth retail revolution,new retail has made great progress in China in recent years.However,there are gray areas such as imperfect legal system,inadequate industry supervision and asymmetric social information.Some illegal financial activities using new forms of business and new retail seriously impair national economic development and social stability.The crime of illegal fund-raising in new retail is characterized by digitalization of operation core,compound of criminal chain,rapid iteration of main body,prop of goods and services,pyramid marketing of organizational development and concealed capital flow.There are some difficulties in identifying cases due to the new mode,collecting evidence due to the large amount of data,and maintaining stability due to the complex participants,which bring new challenges to the economic investigation department of the public security organs.Based on the actual case analysis and the introduction of“the Regulations on The Prevention and Disposal of Illegal Fund-raising”,it is of great significance to study the characteristics and detection and prevention measures of new retail illegal fund-raising crimes and establish a warning and monitoring mechanism for the public security organs to pay equal emphasis on fighting and prevention and to construct a comprehensive governance pattern.
