区块链技术在资金溯源取证中的探索——以涉众型经济犯罪为例

Exploration of Blockchain Technology Applied in Evidence Collection Concerning Tracing to the Capital Source:Take Economic Crimes Involving the Mass as an Example

经济犯罪持续增加,其中以涉众型经济犯罪最为突出。如何进行资金查控、资金筛选、资金穿透等方面的取证,实现资金溯源,是侦查实践中取证面临的难题。传统电子数据取证手段会出现获取电子数据不完整、固证程序繁琐等问题。为了克服巨量离散涉案电子数据带来的取证困难,以区块链特有的属性再结合密码学、电子签名等网络技术所特有的去中心化、安全系数高、信任程度高等特征,对区块链技术在涉众型经济犯罪资金溯源侦查取证、固证技术方面相关理论及核心优势加以探索分析,进而提出以区块链技术为架构的系统性取证、固证技术方案及模型,以期对侦查实践作出理论指导。

Economic crimes continue to increase,among which those involving the mass are the most prominent.How to collect evidence in terms of fund inspection and control,fund screening,and fund penetration,and realize the tracing to the capital source has become a difficulty facing the investigators in practice.In addition,the traditional means of evidence collection have deficiencies such as incomplete acquisition of electronic data and complex procedures for evidence fixation.In order to overcome the evidence-collection problems caused by the huge amount of discrete electronic data involved in a case,this paper,based on summarizing the unique attributes of blockchain and combining with the characteristics of decentralization,high security coefficient and high-degree trust of network technologies including cryptography and electronic signatures,tries to explore and analyze relevant theories and core advantages of blockchain technology in the evidence collection concerning tracing to the capital source of economic crimes involving the mass and technology of evidence fixation.Then,it proposes blockchain-technology-based systematic schemes and modes of evidence collection and fixation for providing theoretical guidance to the investigative practice.
