福利还是保护?——中国《儿童福利法》立法问题研究

Welfare or Protection? Research on the Legislation of China’s Child Welfare Law

在《儿童福利法》立法过程中,如何处理儿童保护与儿童福利之间的关系非常关键。本文首先从理念、对象、供给主体和模式等方面对儿童保护和儿童福利之间的异同进行比较,在此基础上分析我国儿童法律政策中的保护和福利内涵,最后提出我国《儿童福利法》立法应该采用综合模式,并在普惠性理念的基础上满足儿童健康成长过程中的基本需求。

In the legislative process of the Child Welfare Law,how to deal with the relationship between child protection and child welfare is of great importance.This paper first compares the similarities and differences between child protection and child welfare from the various aspects of concepts,suppliers,beneficiaries and models,then analyzes the connotations of protection and welfare in China’s child laws and policies,and finally makes the proposal that the legislation of China Child Welfare Law should adopt a comprehensive approach to satisfy the essential needs of children’s healthy growth with universal benefits.
