摘要
区块链技术的去中心化、不可篡改、不可删除等特性与法律赋予个人信息保护的删除、更改要求之间存在冲突。区块链技术的应用场景中存在客观上无法删除、更正或者不适宜删除、更正的情况,亟须提出个人信息保护中删除权、更正权实现的替代性措施。应明确数字技术下的删除概念和效果标准,以“逻辑删除”为主导,以达到与个人信息无关联、不能回溯和无法识别的删除效果为标准。对区块链技术应用场景开展事先合理评估,重点考量个人信息删除权、更正权的实现方案。合理解释个人信息保护中删除权、更正权的内涵和要求,使区块链技术应用与个人信息删除、更正的权利实现协调。
There is a conflict between the decentralization, immutability, non-deletion of blockchain technology and the deletion and modification requirements granted by the law to protect personal information. In the application of blockchain technology, there are situations in which it is objectively impossible to delete, correct or inappropriate to delete or correct. It is thus urgent to propose alternative measures for the realization of the right to delete and correct in the protection of personal information. It is necessary to clarify the concept and effect standards of deletion under digital technology, and take “logical deletion” as the leading standard to achieve the effect of deletion that is not related to personal information, nonretroactive, and unidentifiable.
