我国网络版权内容过滤措施的实施路径分析

Analysis on the Implementation Path of China’s Network Copyright Content Filtering Measures

随着信息传播速度的不断提升,作为事后救济手段的避风港规则难以向版权人提供及时、有效的版权保护。为应对网络版权侵权形式的不断变化,版权内容过滤技术应运而生。欧盟《数字化单一市场版权指令》就网络内容分享平台的版权内容过滤义务作出明确规定,开启了网络版权责任配置模式的新路径。我国作为互联网产业高速发展的大国,为促进网络版权秩序的健康发展,应立足于当前网络版权保护的现状,并在《中华人民共和国民法典》的指引下,通过借鉴国际先进的立法经验,厘清版权过滤措施与合理使用、用户隐私权以及言论自由的界限,从而明确过滤主体的适用范围,设置合理的过滤标准和错误过滤的救济机制,以构建具有中国特色的网络版权内容过滤制度。

With the increasing speed of information dissemination,the safe harbor rule,as a relief measure,is difficult to provide timely and effective copyright protection to copyright owners.In response to the ever-changing forms of online copyright infringement,copyright content filtering technology came into being.EU Digital Single Market Copyright Directive clearly stipulates the obligation of copyright content filtering of online content sharing platform,which opens a new era of network copyright liability allocation mode.As a big country with rapid development of Internet industry,in order to promote the healthy development of network copyright order,China should base itself on the current situation of network copyright protection,and under the guidance of the Civil Code of the People’s Republic of China,draw lessons from advanced international legislative experience,clarify copyright filtering measures and reasonable use.In order to clear the scope of application of the filtering subject,set reasonable filtering standards and error filtering relief mechanism,in order to build a network copyright content filtering system with Chinese characteristics.
