摘要
新《档案法》加大了档案开放利用力度、增加了公民档案利用权利救济条款,但公民在档案利用实践中仍存在着一些困难和障碍。本文基于两起档案利用案例,分析了各案例在认定事实错误、适用法律不当等方面的违法表现及相关法规制度不完善、档案管理人员没有切实贯彻执行档案法和档案主管部门监督机制不健全等违法原因。为保障公民档案利用权利顺利实现,不仅需要档案馆全面坚决贯彻落实新档案法律法规,而且需要档案主管部门加强监督管理、各机关单位持之以恒做好档案法律宣讲工作,还需要档案学界做好相关法律研究阐释、各级各类档案部门畅通社会参与监督渠道等。
The new'Archives Law'has strengthened the opening up of Archives and increased the relief clauses of citizens'archive rights,but there are still some difficulties and obstacles in the practice of citizens'archive utilization.Based on two cases of file utilization,this article analyzes the violations of the facts and improper application of laws in each case,the imperfection of relevant laws and regulations,the failure of Archives management personnel to effectively implement the Archives law,and the imperfect supervision mechanism of Archives authorities.Reasons for illegality.In order to ensure the smooth realization of citizens'right to use Archives,it is not only necessary for Archives to fully and resolutely implement the new Archives laws and regulations,but also for Archives authorities to strengthen supervision and management,and for all agencies and units to persevere in preaching the Archives law,and Archives academic circles to do well in related laws.Research and interpretation,and unblocked channels for social participation and supervision of Archives departments at all levels and types.
