我国境外追赃间接追回机制的法治优化

Legal Optimization of the Indirect Recovery Mechanism of Overseas Stolen Money in China

全球化背景下,腐败犯罪赃款的跨境转移渠道日益复杂、操作便捷,对此,《联合国反腐败公约》通过间接追回机制为各国实现境外追赃提供了依据。尽管目前我国境外追逃工作取得了重大进展,但其成效明显不足。通过对《联合国反腐败公约》有关规定和我国国内立法的分析,以完善细化特别没收程序和缺席审判程序、完善完整的刑事没收体系、建立承认与执行外国刑事判决制度、完善腐败资产分享机制以及完善境外追赃工作体系等,对中国特色的境外追赃间接追回运行机制进行法治优化具有重要意义,为我国境外追赃工作提供理论支撑,为世界反腐败追赃提供务实有效的中国方案和智力支持。

In the context of globalization,the cross-border transfer of stolen money from corruption crimes is becoming more and more convenient,which makes the crimes more complex.The United Nations Convention against Corruption provides a basis for countries to achieve overseas recovery of stolen money through indirect recovery mechanisms.Although China has made significant progress in the work of recovering stolen goods abroad,the effectiveness is obviously insufficient.Through the analysis of the relevant provisions of The United Nations Convention against Corruption and China’s domestic legislation,the paper proposes to improve and refine special confiscation procedures and default procedures,complete the criminal confiscation system,establish a system for the recognition and enforcement of foreign criminal judgments,improve the mechanism for sharing corrupt assets,and improve the work system for recovering overseas stolen money.This study provides theoretical support for the work of recovering overseas stolen money and offers practical and effective Chinese experience and intellectual support for the world’s anti-corruption recovery of stolen money.
