通向创新型国家的司法保护之路:来自知识产权法庭设立的证据

The Judicial Protection Road to an Innovative Country:Research on the Establishment of Intellectual Property Courts

知识产权司法保护是推进创新型国家建设的重要保障,设立知识产权法庭是充分发挥知识产权司法保护促进创新发展的必要路径。本文利用各地设立知识产权法庭的准自然实验,采用双重差分法分析了加强知识产权司法保护对企业创新的影响。研究发现,知识产权法庭设立带来的知识产权司法保护有效激励了企业创新,企业创新能力提升主要体现在技术含量更高的发明专利;中介效应发现,知识产权司法保护通过提高企业研发投入的途径来激励企业创新。因此,在适当加大知识产权司法保护力度、改善企业创新的法制环境的同时,还应进一步提高知识产权执法水平,促进企业创新能力和效率的提高,为知识产权司法体系建设以及创新驱动发展战略提供支持。

The judicial protection of intellectual property is an important guarantee to promote the construction of an innovative country.The establishment of intellectual property court is the key path to give full play to the judicial protection of intellectual property and promote innovation development.Based on the quasi-natural experiment of establishing intellectual property court by local intermediate people’s Court,this paper analyzes the influence of strengthening judicial protection of intellectual property on firm innovation by using the difference in difference method.The study found that the judicial protection of intellectual property rights brought about by the establishment of intellectual property court effectively stimulated firm innovation,and the enhancement of firm innovation was mainly reflected in the invention patents with higher technological content.Further analysis of the influence channel inspection showed that the judicial protection of intellectual property can stimulate enterprise innovation by increasing firm R&D investment.Therefore,while appropriately strengthening the judicial protection of intellectual property and improving the legal environment for firm innovation,we should also further improve the level of intellectual property law enforcement,promote the improvement of the overall level of firm innovation ability and efficiency,provide support and guarantee for the construction of intellectual property judicial system and the development of innovation driven development strategy.
