跨境数据流动的国际规则动态与我国对策

为了争夺数据资源,各国纷纷以属人管辖、属地管辖等管辖原则强化对数据资源的管控。为防范跨境数据流动带来的安全风险、实现数据价值最大化和促进数字经济的可持续发展,中国应加快建立跨境数据流动法律规则体系,在尊重各国主权与维护国际社会共同利益的基础上,秉承发展与安全并重的理念,在对数据进行分级分类的基础上确立差异化的跨境数据流动管理措施,协商共建数据开放共享机制,探索以数据资源的惠益分享模式解决分歧或冲突,推动制定统一的国际规则和打造公平互利的国际合作机制,促进数据依法有序自由跨境流动,加强对数据弱国的援助,化解“数字鸿沟”,使各国平等获得更多发展机遇和更大的发展空间,促进全人类的共同繁荣。

In competition countries have strengthened their control over data resources with the principles of personal jurisdiction and territorial jurisdiction.China should accelerate the establishment of a legal system for cross-border data flow to prevent the security risks it causes,so as to maximize the value of data and promote the sustainable development of digital economy.With respect for the sovereignty of countries and common interests of the international community,China adheres to the concept of development and security,establishes differentiated cross-border data flow management measures based on data classification,and negotiates for an open data sharing mechanism.China also explores the benefit-sharing model of data resources to resolve conflicts,promotes unified international rules and creates a fair and mutually beneficial international cooperation mechanism,facilitates the legal and orderly free flow of data across borders,strengthens assistance to countries weak in data and resolves the“Digital Gap”,so that all countries may have equal access to more development opportunities and larger development space,and the common prosperity of all mankind can be advanced.
