后疫情时代示范法在我国公共卫生立法中运用的构想

The Conception of Applying Model Law in Chinese Public Health Legislation in the Post-pandemic Era

在后疫情时代借鉴并运用示范法这一国际常用立法模式,将有助于促进国际社会各主体之间在法律规范内开展合作,实现共同抗击新冠肺炎疫情、稳步恢复国际正常秩序。公共卫生示范法的法律属性是国际“软法”,其普适性特征使之具有成为“国际抗疫指南”的天然优势;为了更好把握抗击新冠肺炎疫情的主动权,应注重汲取现有国际公共卫生领域内的有益法治经验,并组建一支多学科的专业队伍来参与立法过程。

Drawing on and applying the model Law,a commonly used international legislative model in the post-pandemic era will help promote cooperation among main bodies in the international community within legal norms,and jointly fight against COVID-19 and steadily restore the normal international order.The legal nature of the model law on public health is international soft law,and its universality makes it a natural advantage to become an international anti-pandemic guide.In order to better grasp the initiative in the fight against COVID-19,it is im⁃portant to draw on the useful experiences of the rule of law in the field of international public health and establish a multidisciplinary team of professionals to participate in the legislative process.
