有关“检察机关鉴定意见专门审查指引”的研究

Research on the"Guidelines for Special Examination of Procuratorial Organs'Appraisal Opinions"

检察机关对鉴定意见开展专门审查活动,在刑事诉讼司法实践中尚缺乏系统性的制度规定,审查的理论与操作存在一定的盲区。本文从刑事诉讼角度分析鉴定意见专门审查实践中存在的问题与困境,尝试探求“检察机关鉴定意见专门审查指引”制度构建思路,提出研究解决相关制度的编制原则、路径方法,能供该审查提供实践操作性的参考范式。

There is still a lack of systematic system in the judicial practice of criminal procedure for procuratori⁃al organs to carry out special examination of expert opinions,and there are certain blind spots in the theory and oper⁃ation of examination.This paper analyzes the problems and dilemmas existing in the practice of special examination of expert opinions from the angle of criminal procedure,tries to explore the idea of constructing the system of"guide⁃lines for special examination of expert opinions of procuratorial organs",and puts forward the compilation principles and approaches to study and solve the relevant systems,which can provide a reference paradigm for the practice of the examination.
