摘要
在平台经济的冲击下,现有劳动规范体系已然无法有效应对:新就业形态劳动者难以认定为劳动关系,无法受到传统劳动基准的保护,司法机关与行政机关也无法采取有效的措施。此外,平台用工的传统劳动者也面临着平台企业控制劳动过程,现有救济手段不完善的困境。而劳动公益诉讼具有维护劳动基准、分散司法压力、促进社会参与等功能,是承担起弥补立法与现实之间裂缝的最佳选择。通过劳动公益诉讼多层次手段维护传统劳动者劳动基准的同时,在劳动环境、工资发放、个人信息保护、社会保险等方面维护新就业形态劳动者基本权益,并推动社会化的新型劳动基准规范建立,促进法律制度落实与行政机关和工会改革,最终达到维护平台经济下的劳动者权益,实现社会的公平与正义的目的。
The existing labor regulation system cannot effectively cope with the platform economy:it is difficult for the platform workers to be identified as working relationship,so they cannot be protected by traditional labor standards,and judicial and administrative organs cannot take effective measures.In addition,the traditional laborers employed by the platforms are also faced with the dilemma that the enterprises control the labor process and the present relief means are not perfect.Labor public interest litigation is the solution,because it has the functions of maintaining labor standards,dispersing judicial pressure,and promoting social participation.Through labor public interest litigation,the platform workers’rights and interests,such as working environment,salary,personal information protection,and social insurance,can be protected,establishment of new labor standards and norms can be accelerated,and the implementation of the legal system and the reform of administrative organs and labor unions can be promoted.In the end,the rights and interests of workers under the platform economy can be safeguarded and social equity and justice can be promoted.
