习近平法治思想“十一个坚持”的法理逻辑结构与功能透析

An Analysis of the Legal Logical Structure and Function of “Eleven Persistence” in Xi Jinping Thought on Rule of Law

中央全面依法治国工作会议首次提出"习近平法治思想"这一概念。习近平法治思想既是党的十八大以来以习近平同志为核心的党中央通过法治方式治国理政的集体智慧的结晶,也是习近平总书记作为马克思主义理论家、思想家对法治中国建设实践作出的全面和系统的法理思考,兼具党的集体领导与领袖个人贡献两方面的理论生成要素,是马克思主义法治理论中国化的最新成果,也是中国特色社会主义法治理论的新形态、新发展。如何全面、系统、科学地阐释习近平法治思想的理论内涵,构建习近平法治思想理论体系,是当前法学界面临的一项重要理论研究课题。习近平总书记提出的"十一个坚持"构成了习近平法治思想的核心要义,其理论性质和特征直接决定习近平法治思想理论体系的建构方向。从法律关系的法理出发,在中国特色社会主义法治关系层面上认识"十一个坚持"的思想内涵,"十一个坚持"全面体现了中国特色社会主义法治理论的特色,对法治关系的主体、客体、目的、手段以及国家权力和公民权利等基本逻辑要素进行科学分类和详细论述,上述理论特质为科学构建习近平法治思想理论体系提供了必要的理论资源。

The Work Conference on Comprehensively Governing the Nation according to the Rule of Law organized by the Central Committee of CPC put forward for the first time the concept of Xi Jinping Thought on the Rule of Law. Xi Jinping Thought on the Rule of Law is not only the crystallization of the collective wisdom of the Party Central Committee in governing the nation according to the rule of law since the 18 th National Congress of the Communist Party of China, but also comprehensive and systematic jurisprudence thinking over practice of building the rule of law in China by General Secretary Xi Jinping as a Marxist theorist and jurist. As a combination of the theoretical generation elements of the party’s collective leadership and individual leader’s contributions, it is the latest achievement of the Sinicization of Marxist theory of the rule of law, and a new form and development of the theory of the rule of law of socialism with Chinese characteristics. How to systematically expound the theoretical significance of Xi Jinping Thought on the Rule of Law is an important theoretical research topic currently facing the legal circle. The “essence” as represented by the “Eleven Persistence” and its theoretical nature and characteristics directly determine the direction of the construction of Xi Jinping Thought on the Rule of Law. Starting from the perspective of legal relations and the understanding of the “Eleven Persistence” in the sense of the socialist rule of law with Chinese characteristics, it can be found that the “Eleven Persistence” fully embodies the characteristics of the socialist rule of law theory with Chinese characteristics. The subject, object, purpose, means, state power and civil rights and other basic logic elements of the rule of law are scientifically classified and discussed in detail, providing the necessary resources for the scientific construction of Xi Jinping Thought on the Rule of Law.
