常态防疫模式下行政权隐性扩张新形态与法治监督——以“就地过年”行政倡导为切口

The New Recessive Expansion Form of Administrative Power and Its Legal Supervision Under the Regular Epidemic Prevention Mode--Taking the Administrative Advocacy of“Celebrate the Spring Festival in Place”as Entrance

行政权在常态防疫模式下的隐性扩张主要表现为行政主体外延虚化隐性扩权、免责条款逃逸隐性扩权、行政相对人负担性要素加码隐性扩权、特别行政协调性组织隐性扩权和行政行为性质混淆隐性扩权。而上述新形态背后的软法资源匮乏、制度立法缺位、行政权力博弈、央地逻辑差异以及基层压力超负则是未能对行政权隐性扩张新形态进行法治监督的关键。对防疫常态化背景下行政权隐性扩张的法治监督要强化宪法体系性诠释,树立民生主义法治观,从实质意义上提升多元主体的法治监督力。为了促进行政法治监督制度从“工具性托付”迈向“价值性托付”,应完善行政法治监督的规范体系,通过立法与治理二元路径,整合行政法治监督资源,形成特别状态下的行政法治监督范式。

The recessive expansion of administrative power under the regular epidemic prevention mode is mainly manifested as the extension of the administrative subject,the escape of the exemption clause,the increase of the administrative relative party’s bearing elements,the implicit expansion of the special administrative coordination organization and the confusion of the administrative behavior nature.The lack of soft law resources,the absence of system legislation,the logical difference between the central and local governments,the excessive pressure at the grass-roots level and the game of administrative power are key elements to supervise the new recessive expansion form of administrative power under the rule of law.Based on this,the legal supervision of the recessive expansion of administrative power under the background of regular epidemic prevention should strengthen the systematic interpretation of the constitution,establish the law view of people’s livelihood,and enhance the legal supervision power of multiple subjects in essence.As to promote the administrative legal supervision system from“instrumental entrustment”to“value entrustment”,it should improve the legal system of administrative legal supervision,integrate administrative legal supervision resources through the dual path of legislation and governance,and form a special administrative legal supervision paradigm.
