摘要
就业权对大学生个人和社会意义重大,要以帮助大学生就业为核心开展研究,以建立合法有序的就业市场。从大学生就业阶段权益内容及侵权原因入手,围绕政策、法治、政府、高校和个人现状,分析各类影响因素,通过增设反就业歧视法、增加公益诉讼、实施证据倒置、设立维权绿色通道、建立用工黑名单、加速教育融合、开展新闻监督、实施法治实践等措施,发挥大学生学习优势,以保障就业权实现,促进个人发展和维护社会稳定的目的。
The right to employment is of vital importance to college students both personally and socially,so it is necessary to carry out researches on helping college students to get employed so as to establish a legal and orderly employment market.Taking the content of rights and interests of college students in the employment stage and the causes of infringement as the cutting point,this paper gives an analysis to various influencing factors regarding the national policies,legislation,governmental governance,and higher education system,and the personal aspects of the student themselves.The writer put forward that in order to ensure college students′employment rights,promote their individual development and maintain the social stability,an employment discrimination act should be added,the public welfare lawsuit should be increased,evidence inversion shouldbe implemented,a rights protection green channel shouldbe built,employment blacklists shouldbe established,educational integration shouldbe accelerated,news supervision shouldbe strengthened,practicing the rule of law shouldbe guaranteed and also college students′knowledge shouldbe fully played.
