环境法典背景下宣示性条款的功能定位与法律完善

Functional Orientation and Legislative Improvement of Declarative Clauses in Environmental Laws

我国环境法律中存在诸多宣示性条款,将如此数量的不具有裁判依据功能的宣示性条款规定在环境保护法之中,虽然在适用性上存在诸多桎梏,但是这种宣示性条款的引入,不啻彰显了环境保护法公法的属性,更是对于环境单行法的价值引导,以及对于环境保护行为的激励。环境法律上的宣示性条款在立法上过于赘述,在实施上缺乏实施细则。在我国制定环境法典的背景下,应扩大环境法的宣示性条款的适用范围,同时注重环境法内部宣示性文本的协调,注重宣示性条款的制度群建立与脉络化完善。在具体运行过程中,应出台具体的配套实施细则,以期有助于环境法律的完善,促进我国环境保护事业的更好发展。

There are many declaratory clauses in China’s environmental laws.Although there are many shackles in applicability, the introduction of such declaratory clauses not only highlights the attribute of public laws of environmental protection laws, but also guides the value of separate environmental laws and encourages environmental protection behavior.While in the legislative system, the declarative clauses in environmental laws are too verbose in legislation, and there is a lack of implementation detailed regulations.If China’s environmental code is to be formulated in the future, the declaratory clauses of environmental laws should be simplified in the legislative style, and specific supporting implementation rules should be issued in the concrete operation, so as to achieve improvement of the environmental laws and promotion of China’s environmental protection cause.
