论信用承诺及其制度完善

On Credit Commitment and Its Institutional Improvement

厘清信用承诺、告知承诺的概念,并对信用承诺进行分类,指出告知承诺是信用承诺的一种形式。对告知承诺的法律性质进行辩析,认为告知承诺不是一个独立的具体行政行为,而是构成具体行政行为的前提条件。针对我国信用承诺制度存在合法性存疑、承诺相关内容失范、违反承诺的法律后果失衡等法治困境,提出增设行政许可简易程序、确定信用承诺的范围、规范信用承诺的内容与法律效果的对策建议。

This article clarifies the concepts of credit commitment and informational commitment,and classifies credit commitment,and argues that informational commitment is a form of credit commitment.It elaborates on the legal nature of informational commitment and concludes that informational commitment is not an independent specific administrative act,but a prerequisite for constituting a specific administrative act.It is recommended that we should introduce a simple procedure for administrative licensing,specifying the scope of credit commitment and regulate the content and legal effects of credit commitment in light of the dilemmas of China’s credit commitment system,such as the doubtful legality,the misconduct of commitment-related content,and the imbalance of legal consequences of breach of commitment,etc.
