帮助信息网络犯罪活动罪的立法解读与司法纠偏

Legislative Interpretation and Judicial Correction for the Crime of Aiding Information Network Crime

帮助信息网络犯罪活动罪是立法的新罪名,其在实践中的适用存在争议,值得探讨。我国《刑法》中不存在直接规定帮助行为的条款,第25条第1款关于共同犯罪的规定涵盖了对帮助行为的处罚。《刑法》分则将帮助行为实行化符合国际立法潮流与国内犯罪治理需要,阐明了帮助信息网络犯罪活动罪等“帮助型犯罪”的行为本质。为信息网络犯罪活动提供帮助之行为的存在是认定此罪的逻辑起点,但不是此罪成立的全部条件,司法实践中仍需认定帮助者的认识内容以及帮助者与被帮助者之间有无通谋,确定其帮助故意。帮助信息网络犯罪活动者不应被定位于相应犯罪的从犯,而应赋予其独立的量刑空间,因其可能在多人犯罪中发挥主要作用。

The crime of aiding information network crime is a new crime in legislation.Its application in practice is controversial and worthy of discussion.There are no provisions directly stipulating the act of aiding in China’s criminal law.The provisions on joint crime in paragraph 1of Article 25 cover the punishment of the act of aiding.The specific provisions of the criminal law implement the aiding behavior,which meets the trend of international legislation and the needs of domestic crime governance,and expounds the behavior essence of"aiding crime"such as the crime of aiding information network crime.The existence of the act of providing help for information network criminal activities is the logical starting point for the determination of this crime,but it is not all the conditions for the establishment of this crime.It is still necessary to determine the understanding content of the helper and whether there is collusion between the helper and the helped,and determine their intention to help.aiding information network criminals should not be positioned as accomplices to corresponding crimes,but should be given independent sentencing space,which may play a major role in multi person crimes.
