观中立帮助行为刑事处罚有关理论之发展脉络,其趋势大致可以概括为从全面处罚到限制处罚。但对中立帮助行为进行刑事处罚时,最重要的问题则是依据何种理论才能对中立帮助行为进行合理地限制,以契合限制处罚的发展趋势。现有理论中客观限制说并不能恰当地限制处罚范围,因此限制中立帮助行为处罚范围的关键在于主观限制说。但传统的主观限制说亦未明确中立帮助行为刑事处罚边界的问题,而建立在对中立帮助行为进行实质性解释基础上的主观限制说具有一定的合理性,能够恰当地限制中立帮助犯的刑事处罚范围。

The general trend of the theory of criminal punishment of neutral helping behavior is developed from comprehensive punishment to restricted punishment.However,the most important problem involved in the criminal punishment of neutral helping behavior is based on what theory can we reasonably limit the neutral helping behavior in order to meet the development trend of limiting punishment.The existing objective restriction theory does not properly limit the scope of punishment,so the key to limit the scope for neutral helping behavior is the subjective restriction theory.However,the traditional subjective restriction theory fails to deal with the problem of defining the boundary of the criminal punishment of neutral helping behavior.The subjective restriction theory based on the substantive explanation of neutral helping behavior has certain rationality and properly limits the scope of criminal punishment.
