专利披露规则是技术标准制定过程中的一项重要制度性安排,对规制专利权滥用、促进技术标准实施、维护市场竞争秩序和促进产业良性发展具有重要意义。结合对专利纳入技术标准的过程分析可以看出,故意隐瞒专利信息和过度声明专利信息是当前违反专利披露规则的主要表现形式。为了填补这一规则缺陷,本研究重点立足标准化组织视角,提出了进一步明确披露主体及责任、明确具体披露时机、运用现代科技手段提高披露质量和确立违反披露规则的惩戒机制等方面的对策建议。

Patent disclosure rule is an important institutional arrangement in the process of technical standard formulation. It is of great significance to regulate patent abuse, promote the implementation of technical standards, maintain market competition order and promote the benign development of industry.Combined with the analysis of the process of incorporating patents into technical standards, it can be seen that deliberately concealing patent information and over declaring patent information are the main manifestations of violating patent disclosure rules at present. In order to fill this rule defect, the research focuses on the perspective of standardization organization, and puts forward countermeasures and suggestions on further clarifying the disclosure subject and responsibility, clarifying the specific disclosure time, using modern scientific and technological means to improve the disclosure quality and establishing the disciplinary mechanism for violating the disclosure rules.
