不动产登记中的压盖问题及处理——以广州市为例

Overlaying Problems and Solutions in Real Estate Registration:Take Guangzhou City as an Example

通过经验总结以及实证研究的方法,分析了信息化管理背景下不动产权属争议问题的调处方式,以期为当前不动产登记信息化管理实务提供参考。结果表明,当前不动产登记信息化管理中权属争议的主要表现形式为“压盖”,压盖问题的处理是新时期不动产登记工作中权属争议问题调处的核心。其次,压盖指代的权属争议问题是否真实存在具有不确定性,仍然需要依靠人力进行判定。当前压盖问题处理机制尚不成熟,研究从责任机构、处理流程、协调方式等方面分析了当前压盖问题处理机制的不足并提出了相应的对策和建议。

Through the method of experience summary and empirical research,this paper analyzes the mediation methods of real estate ownership disputes under the background of information management,in order to provide reference for the current practice of information management of real estate registration.The results show that the main form of ownership disputes in the current information management of real estate registration is"Overlaying",and the solutions of overlaying issue is the core of the mediation of ownership disputes in the new era of real estate registration.Secondly,it is uncertain whether the ownership dispute referred to by the overlaying really exists,and it still needs to rely on manpower to determine.At present,the handling mechanism of overlaying problem is not mature.The deficiencies of the current overlaying problem handling mechanism are analyzed from the aspects of responsible organization,handling process and coordination mode,and the corresponding countermeasures and suggestions are put forward.
