The Power Logic in Judicial Algorithmic Decision-Making

摘要 伴随数字社会转型和智慧司法建设推进,司法算法决策展现出不可替代的优势,同时带来对权力结构的冲击、法律实质内容的改变以及对公民道德伦理的影响。司法算法决策的权力逻辑,在发挥其效能方面必须维护司法权力起止的有限性、决策的集中性、裁判的公开性和运作目标的整体性特征;权力运行的过程,在于充分发挥算法系统嵌入司法系统的叠加性优势,合理地进行司法程序的算法设置和布局;权力运行的效果,体现出系统博弈中公平问题的复杂性,并以可解释性模型的构建勾连法律的平等权利和非歧视性规制;司法算法决策作为一种权力延伸,必须遵循算法执行层面的伦理和人性化因素保障,以实现司法责任的落实,作为权力的边界,防止权力的旁落。 With the transformation of the digital society and the development of the smart judicial construction process,judicial algorithm decision-making has shown irreplaceable advantages,and at the same time,has brought an impact on the power structure,changes in the substance of the law,and an impact on the morality and ethics of citizens.In terms of effectiveness,judicial algorithm decision-making must maintain the limited beginning and end of judicial power,the centrality of decision making,the openness of adjudication,and the overall characteristics of operation goals.The process of power operation of judicial algorithm decision-making is to give full play to the superposition advantage of the algorithm system embedded in the judicial system,and to reasonably set up and layout the algorithm of judicial procedures.The effect of power operation reflects the complexity of fairness issues in the system compound and links the equal rights and non-discriminatory regulations of the law with the construction of an interpretable model.As an extension of power,judicial algorithm decision-making must ensure that the algorithm protects ethical and human factors at the execution level,to realize the implementation of judicial responsibility,and to clarify the boundaries of power to prevent power from being replaced.
