新法考背景下案例教学法在本科刑法教学中的应用

摘要 自2018年新法考实施以来,命题组逐年提高对案例分析题的考察力度。在此背景下,一线刑法学教师应坚持以典型性、时代性、适用性和启发性作为甄选刑事案例的指导标准。在具体教学中,应做好课前准备、组织讨论、教师总结以及课后延伸。此外,既要将案例教学与举例教学加以区分,也要避免将案例教学与其他教学方式相互对立,甚至是独立开设案例教学课程。 Since implementation of the new law examination in 2018,it seems that proposition group have constantly increased inspection of case analysis questions.Under such case,criminal law teachers should adhere to the typicality,times,applicability and inspiration as the guidelines in selecting criminal cases.In concrete teaching situation,it is necessary to fulfill pre-class preparation,organization of discussion,teacher summary and after-class extension.In addition,it is important to distinguish case teaching from example teaching.Similarly,it is essential to avoid the opposition between case teaching and other teaching methods.Also,it is impossible to independently set up case teaching courses.
