清代新疆建省后鲁克沁郡王司法职能探析

On the Judicial Function of the King of Lukeqin after the Establishment of Xinjiang Province in the Qing Dynasty

清廷统一新疆过程中,额敏和卓助清军平回部有功,封郡王,清廷在其所属吐鲁番领地实行札萨克制,吐鲁番王府拥有较大司法权。清末新疆建省后,吐鲁番郡王所属土地、人民,分隶于吐鲁番厅和鄯善县,吐鲁番郡王移居鲁克沁城,王号依旧世袭,但鲁克沁郡王已无司法权,其职能是辅助吐鲁番厅对属地发生案件进行查验、禀报和执行判决等。通过对相关案例的实证分析,归纳总结了鲁克沁郡王在司法实践中的地位和作用。

Before the establishment of Xinjiang province in the Qing Dynasty,Emin Khwaja helped the Qing army to calm down Hui Jiang,and granted the prefecture king.The Qing government exercised Jasag restraint in Turpan,and the king of the prefecture had certain judicial power.After the establishment of Xinjiang province in the late Qing Dynasty,the land and people belonging to the king of Turpan were divided into Turpan Hall and Shanshan County,and the king of Turpan moved to Lukqin City.The king's title was still inherited by his family,but the king of Lukqin no longer had judicial power,and his duty was to assist The Turpan Hall in the inspection,pre-trial and execution of judgments in judicial practice.This paper combs out the position and role of King lukqin in judicial practice through empirical analysis of relevant cases.
