版权蟑螂现象的法律规制——以著作权集体管理制度为视角

Reining in the Copyright Troll——From the perspective of collective management of copyright

数字经济时代,著作权的广泛传播引发版权蟑螂现象,大规模的版权诉讼异化了知识产权的激励机制,损害了社会创新,干扰了社会主义市场经济公平竞争秩序,浪费了国家司法资源,也使著作权集体管理组织无法有效行使管理职能和社会职能。立足于著作权集体管理制度的视角,指出可以通过权利人平行授权、建立健全联合著作权线上交易系统、构建延伸性著作权集体管理制度等路径,从根本上规制滥诉行为。

In the era of digital economy,the widespread dissemination of copyright leads to the phenomenon of copyright cockroaches (namely,copyright troll).Large scale copyright litigation alienates the incentive mechanism of intellectual property,damages social innovation,interferes with the fair competition order of socialist market economy,wastes national judicial resources,and makes the copyright collective management organization unable to effectively exercise its management and social functions.Based on the perspective of copyright collective management standards,we should extend the right boundary of obligees,establish and improve the joint copyright online trading system,and build an extended copyright collective management system,so as to fundamentally regulate the abuse of litigation.
