Constructing Community’s Order in the Interactive Process

在私人房屋产权法制化的过程中,国家设计了业主委员会制度,试图用来保护房屋产权、培育业主自我管理能力、维持社区秩序。基于已有研究的局限性,通过互动性的过程追踪方法,研究社区公共秩序是如何产生的,将是一项建构性的学术创新。借助治理网络理论与过程机制方法,对上海一个案例的深度调查,揭示了纠纷重构社区秩序的基本逻辑,即治理网络之间的互动激活了四个关键机制:规则意识、竞争、监督与自主。这些机制的共同作用平衡了结构上的非均衡的网络关系,同时纠正了治理网络主体的目标偏离。

In the process of legalizing private ownership of houses,Chinese authority has envisioned the homeowners’committee system in order to protect private rights,foster homeowners’self-management capacity,and maintain community order.Based on the limitations of existing studies,it would be a constructive academic innovation to investigate how community public order is produced through an interactive process-tracing approach.Drawing on governance network theory and a process mechanism approach,an in-depth investigation of a case in Shanghai reveals the underlying logic of disputes in reconstructing community order,namely that the interaction between governance networks activates four key mechanisms:awareness of rules,competition,monitoring,and self-management.These mechanisms work together to balance the structurally uneven network relations while correcting the divergent goals of the subjects of the governance network.
