人民调解的模式适用与程序规范化

Reflection on the Mode Application and Procedure Standardization of People’s Mediation

当前人民调解呈现出主导劝服型、辅助促进型和纠纷评价型三种模式。这三种模式在运行过程中暴露出调解的自愿性保障不足、中立性难以保证、调解过程欠缺规范性要素、对事实和责任认定过于"模糊"等程序性问题。对此,应着重健全人民调解的自愿性保障规则,保证人民调解的利益中立和立场中立,提升人民调解的过程规范性,区分不同案件对事实查明和责任划分的不同程序要求,从而促使人民调解在现代纠纷解决体系中发挥出更大效用。

At present,people’s mediation assumes three modes:dominant persuasion,auxiliary promotion and dispute evaluation.In the process of operation,are exposed such procedural problems with these three modes as the insufficient voluntary guarantee of mediation,the difficulty in guaranteeing neutrality,and the lack of normative elements in the mediation process,overly fuzzy identification of the fact and responsibility and so on.Accordingly,we should focus on improving the voluntary safeguard rules of the people’s mediation,ensure the interest neutrality and position neutrality of the people‘s mediation,improve the standardization of the process of the people’s mediation,and distinguish the different procedural requirements of different cases for fact-finding and liability division,so as to promote the improvement of the people’s mediation and let it play a still greater role in the modern dispute settlement system.
