摘要
西方近年兴起的法律与文学运动既有学术派别之间的理论纷争,也有贯彻在它们背后的文明论的论辩意义。从文明史的角度讨论法律与文学课程的主要结构和文明论蕴含,集中以代表古典文明的古希腊悲剧、代表早期现代文明的莎士比亚戏剧和代表未来文明的科幻小说《弗兰肯斯坦》为研究对象,能勾勒出一个立足于文明史论的法律与文学的课程纲要。
By reviewing the background of the rise and development of the legal and literary movement in the West in recent years,this paper mainly discusses the following four issues:What is the research object of law and literature?What is the relationship between law and literature?What is the methodology of law and literature?And last but not least,it analyzes the implications of legal issues embodied in literary works representing different stages of human civilization and designs a course of law and literature from the perspective of the history of civilization.The main contents of this course include:Greek tragedy,which represents the classical antiquity,Shakespeare’s drama,which represents the early modern civilization,and Frankenstein,a science fiction novel representing the future civilization.
