摘要
随着政府数据开放进程的日益深入,以公共数据为基础的大数据产业在不断发展,公共数据立法已成为国家大数据战略的重点制度建设方向。贵州、浙江等地在公共数据开放立法方面进行了非常有益的立法探索,这些地方立法在一定程度上推动了《数据安全法》对公共数据开放制度的法律确认。作为公共数据开放的基础性法律,《数据安全法》仍然存在明显不足,其并未有效回应地方立法中存在的诸多制度问题。公共数据开放有其大数据时代的特殊使命,厘清其与政府信息公开的制度差异,是其立法需要明确的前置性问题。公共数据开放的主要目的在于数据利用,因此公共数据立法也应直面数据利用这一关键环节并进行妥当的制度设计安排。
With the advancement of government data opening,the big data industry based on public data undergoes a continuous development,and public data legislation has become the object of key system construction for national big data strategy.Guizhou,Zhejiang and other places have made very beneficial legislative exploration in public data opening legislation.These local legislations have to a certain extent promoted the legal recognition of public data opening system in Data Security Law.As the basic law of public data opening,Data Security Law has obvious deficiencies,and fails to solve many institutional problems existing in local legislations.To clarify the system difference between public data opening and government information disclosure is the precondition for the legislation.The main purpose of public data opening is data utilization,so public data legislation should make appropriate institutional design about data utilization.
