共同富裕的正义体系及其法律实现

The Justice System of Common Prosperity and Its Legal Realization

随着中国特色社会主义进入新时代,发展的底层逻辑也在悄然置换,共同富裕开始加快实施。法律可以助力共同富裕有序平稳地推进,共同富裕也在生产正义、分配正义和矫正正义三个层面对法律提出了体系性的价值要求。生产正义是共同富裕对法律的第一要求,构成了法律正义的基底价值;分配正义是共同富裕对法律分配制度提出的中心要求,构成了法律正义的核心价值;矫正正义是共同富裕对法律的兜底要求,构成了对前两种正义内涵的必要保障。整合上述正义体系,并通过科学设计将其注入法律的规范构造,再经过法律的有效实施,才能为实现共同富裕提供制度支撑。

As socialism with Chinese characteristics enters a new era,the underlying logic of development has been changing quietly and China’s common prosperity policy implementation also begins to accelerate.The law can help to promote common prosperity orderly and smoothly,and common prosperity also puts forward systematic value requirements to the law in three aspects:production justice,distribution justice and correction justice.Production justice is the first requirement of common prosperity for the law and constitutes the basic value of legal justice.Distribution justice is the central requirement of common prosperity on the legal distribution system and constitutes the core value of legal justice.Correction justice is the fundamental demand of common prosperity for law and constitutes the necessary guarantee for the first two kinds of justice values.Only by integrating the above justice system and injecting it into the normative structure of the law through scientific design and through the effective implementation of the law can we provide system support for the realization of common prosperity.
