On the Criminal Execution Power of Community Correction Institutions

社区矫正机构行使刑事执行权的行为包含监管、教育、帮扶以及不得已时的惩戒,本质上是司法行政权。本文旨在通过阐释社区矫正机构发展历程、分析社区矫正机构履职行为性质来厘清社区矫正机构的刑事执行权,在此基础上探寻重新配置社区矫正机构刑事执行权的路径,期冀对刑事执行理论的进一步深化有所裨益。

The behavior of community correction institutions in exercising criminal execution power includes supervision,education,assistance and punishment when necessary.In essence,it is judicial administrative power.This paper attempts to clarify the criminal execution power of community correction institutions by explaining the development process of community correction institutions and analyzing the nature of their performance of duties.On this basis, this paper explores the path to reconfigure the criminal execution power of community correction institutions,hoping to be beneficial to the further deepening of the theory of criminal execution.
