摘要
法律服务市场的对外开放是北京市“两区”建设过程中完善法治保障的重要环节。当前,北京市法律服务市场具有进一步提升开放水平的必要性。中国在国际经贸条约中的开放承诺是北京市法律服务市场开放的最低标准;中国国内法的相关制度改革又为北京市法律服务市场开放创造了新的政策空间。在吸收借鉴上海自贸区法律服务市场开放经验的基础上,北京市应当以国家安全为市场开放底线,建立稳定有序的市场环境;通过适当开放自然人流动和发展律师事务所合作经营的路径来丰富外国法律服务主体的经营模式;落实境外仲裁机构的引入,建设具有吸引力的国际争议解决中心。
The opening of the legal service market constitutes an important part in improving the protection of the rule of law in the process of the construction of the“two zones”in Beijing.It is necessary to promote the opening of Beijing legal service market to a further level at present.China's commitments in international economic and trade treaties are the minimum standard for the opening of Beijing's legal service market.The reform of relevant domestic rules also provides policy space for the market access of legal service in Beijing.On the basis of absorbing the experience of China(Shanghai)Pilot Free Trade Zone in opening of the legal service market,Beijing should establish a stable market order within the bottom line of national security;by allowing the movement of natural persons properly and developing the cooperation of law firms,Beijing could diversify the business models of subject of legal service;Beijing should also implement the introduction of overseas arbitration institutions to build an attractive international dispute settlement center.
