摘要
该文以近几年频发的网购平台在用户下单后私自取消订单的“砍单”行为为切入点,从“砍单”的定义,有关“砍单”的调查报告和典型的“砍单”案例这三个方面阐明了近几年新兴的“砍单”行为的定义和表现形式等。最后结合案例对“砍单”行为做出了具体的法律分析并且提出了对“砍单”行为的一些应对建议。
This article starts from the“order-cutting”behavior of online shopping platforms that cancelling orders without permission after users place an order,which has occurred frequently in recent years.From the three aspects including the definition of“order cutting”,the investigation report on“order cutting”,and typical“order cutting”cases,we illustrate the definition and manifestation of the emerging"order-cutting"behavior in recent years.Based on the case,we conduct a specific legal analysis on the behavior of"ordercutting"and put forward some countermeasures for this behavior.
