剧本杀店家“出租”盗版剧本的不正当竞争认定

"Renting" Pirated Scripts by Murder Mystery Game Operator under the Unfair Competition Law

剧本杀店家提供盗版文字剧本供玩家临时使用,符合我国《著作权法》中出租权所控制的行为特征,但因出租权保护的客体不包括文字作品而不构成著作权侵权。剧本出租是剧本杀剧本的主要利用方式,出租利益为剧本创作的主要激励,在行业自律和市场自我激励机制无法发挥作用的情况下,可以考虑对剧本著作权人的出租利益予以反不正当竞争法保护。认定剧本杀店家行为构成不正当竞争应仅限于其出租盗版剧本的情形,以避免使用盗版剧本导致出租利益无法向正版剧本售价迁移。店家若不知道其出租的是盗版剧本,且能证明该剧本为自己合法取得并说明提供者的,不承担赔偿责任。

The murder mystery game operators provide pirated literary scripts to players for temporary use,it therefore fits in the behavioral characteristics of the rental right under the Chinese Copyright Law.But it does not constitute copyright infringement at all because the subject matters protected by the rental right do not include literary work.Renting is the main way of using scripts in the murder mystery game industry,and rental interest is the core incentive for script creation.If the industry self-discipline and market self-incentive mechanism cannot work,the anti-unfair competition law may be considered to protect such interests.The liability under unfair competition law should be limited to the circumstance where the operator rents out pirated scripts,so as to avoid the situation where the rental interest cannot be transferred to the sale price of lawful scripts because of pirated copies.If the operator does not know that the rental script is pirated,and can prove that the script is legally obtained and provide the information of script provider,there shall be no liability on damages.
