浅论最接近的现有技术的确定与创造性的判断

摘要 本文从一个实际案例出发,分析选择不同对比文件作为最接近的现有技术影响案例的创造性判断,针对该案例,从技术问题、技术方案、发明构思、发明的目的、效果多角度分析、确定最接近的现有技术,分析最接近的现有技术的选择与创造性判断之间的关系。借鉴欧专局的“问题-解决法”确定最接近的现有技术,将解决的技术问题与最接近的现有技术的考量不断重复、螺旋上升进行创造性的判断。 Starting from a practical case,this paper analyzes the creative judgment of selecting different reference documents as the closest existing technology impact case.Aiming at this case,it analyzes and determines the closest existing technology from the perspectives of technical problems,technical solutions,invention ideas,purpose and effect,Analyze the relationship between the selection of the closest prior art and creative judgment.Learn from the“problem-solving method”of the European Commission to determine the closest existing technology,and make creative judgment by repeatedly and spirally considering the solved technical problems and the closest existing technology.
