Development and Prospect of Administrative Regulations:From the Perspective of Scientization and Democratization

行政法规是中国特色社会主义法治体系“完备的法律规范体系”的重要内容。新中国成立以来,我国行政法规从无到有、日趋规范完备,在社会主义民主法治建设和经济社会发展过程中发挥了重要作用。推进国家治理体系和治理能力现代化、建设中国特色社会主义法治体系、加快建设法治政府,对提高行政法规立法质量、实现科学化民主化提出了新的更高要求。回顾新中国成立以来行政法规科学化民主化发展历程,总结有益经验,查找问题不足,有利于更好发挥行政法规的制度功能,助力推进国家治理体系和治理能力现代化。

Administrative regulations are an important part of the“complete legal norm system”of the socialist legal system with Chinese characteristics.Since the founding of P.R.C.,administrative regulations have become more and more standardized and complete,and have played an important role in the construction of socialist democracy and the rule of law and the process of economic and social development.Promoting the modernization of the national governance system and governance capacity,building a socialist legal system with Chinese characteristics,and accelerating the construction of a government under the rule of law,have put forward new and higher requirements for improving the quality of administrative regulations and making it more scientific and democratic.Reviewing the scientific and democratic development of administrative regulations since the founding of the PRC,summing up useful experience and identifying shortcomings will be conducive to giving better play to the institutional function of administrative regulations and promote the modernization of China’s governance system and capacity.
