“案-件比”案件质量评价体系问题研究

以“案-件比”为核心的案件质量评价体系是司法责任制改革下检察制度改革的配套措施和评判检察机关工作质效的关键性举措,也是检察机关贯彻其人民性的保障性措施。与既往的案件质量评价体系相比,“案-件比”评价体系在实现公正与效率、承载以人民为中心思想以及推动刑事案件质效提升等方面具有显著优势。然而,现实中践行这一评价体系仍存诸多掣肘,其中程序倒流现象为流弊之首。因此,为提升“案-件比”评价体系的运行效能,在检察队伍的建设、促进审查引导侦查与自行侦查相结合、合理管控退回补充侦查和延长审查起诉期限的适用、加强释法说理等方面仍需进一步深化。

The case quality evaluation system with the“case-to-case ratio”as the core is a supporting measure for the reform of procuratorial system and a key measure for judging the quality and efficiency of the work of procuratorial organs under the reform of judicial responsibility system. It is also a safeguard measure for procuratorial organs to implement their nature of people. Compared with the previous case quality evaluation systems, the“ case-to-case ratio ”evaluation system has significant advantages in realizing fairness and efficiency, carrying the people-centered thought and promoting the quality and efficiency of criminal cases.However, there are still many constraints in the practice of this evaluation system, among which the phenomenon of procedural backflow is the worst. Therefore, in order to improve the operation efficiency of the“case-tocase ratio”evaluation system, it is necessary to further deepen the team building of procurators, promote the unity of review-oriented investigation and self-investigation, properly manage and control the application for return of a case for supplementary investigation as well as the extension of time limit for review and prosecution, and enhance the judicial interpretation and reasoning.
