Practice Inspection and Optimization Path of the Procuratorial Supervision of Community Correction

社区矫正检察监督是保障社会行刑依法进行的重要手段,具有多元的价值目标,呈现出教育性、广泛性与协同性的特点。随着刑罚轻缓化的影响、社区矫正法治化的推进,检察监督工作面临新的挑战。从司法实践来看,检察监督理念的落后、内部监督结构的缺陷、传统监管范式的桎梏以及智慧检察应不对不足等现实症结,严重制约着制度有效运行。有鉴于此,我们应当从树立系统性监督的工作理念、推进力量均衡的监督结构、确立个人信息保护的检察责任、发挥智慧检务的技术优势等方面予以完善。同时,社区矫正不是双向交互的一种刑罚执行关系,而是多元主体共同参与的活动,可以适当考虑引入被害人参与机制以及发挥人民监督员在检察监督中的作用。

The procuratorial supervision of community correction is an important means to ensure the social execution according to law.It has multiple value goals and the characteristics of education,universality and synergy.With the influence of the mitigation of punishment and the promotion of the rule of community correction,the procuratorial supervision work is facing new challenges.From the perspective of judicial practice,the backward concept of supervision,the defects of the supervision structure,the shackles of the supervision model and insufficient response of intelligent procuratorial seriously restrict the effective operation of the procuratorial supervision system.In view of this,we should improve the work of establishing the concept of systematic supervision,promoting the balanced structure,determining the procuratorial responsibility of personal information protection,and giving full play to the technical advantages of DOIT.At the same time,community correction is not a punishment-execution relationship of two-way interaction,but an activity of participating of multiple subjects.We can appropriate introduce the mechanism of victim participating and make good use of the people's supervisor system in procuratorial supervision.
