促进体育旅游业发展的立法对策

On Legislative Countermeasures to Promote the Development of Sports Tourism

发展体育旅游业对满足人们美好生活追求、推动旅游业转型升级、优化区域经济发展及促进经济内循环具有重要的现实意义。我国体育旅游业发展起步虽晚,却展现出可观的发展潜力,但也暴露出发展定位不清、市场培育缓慢、人才培养缺乏、风险防范能力低等不足。通过加强立法引领和推动可以为体育旅游业发展设立标准,确立监管规则,提供制度驱动力,促进其高质量发展。结合当前我国体育旅游业立法存在体系不够完备、立法层次偏低、立法内容操作性不强等问题,建议修改《旅游法》《体育法》,构建与高质量发展相匹配的产业管理与服务体系,推进体育旅游业地方立法,进而构建起系统的产业法制体系。

The development of the sports tourism industry has important practical significance for satisfying people’s pursuit of a better life,promoting the transformation and upgrading of the tourism industry,optimizing regional economic development and promoting the internal circulation of economy.Legislation can establish standards for the development of new industries,establish regulatory rules,and also create opportunities for its development and provide institutional driving forces.Therefore,it is necessary to strengthen legislative guidance and promotion to promote the high-quality development of sports tourism.At present,there are some problems in China’s sports tourism legislation,incomplete system,low legislative level,weak operability of legislative content and so on.In terms of legislation,it is necessary to amend the‘Tourism Law’and‘Sports Law’,and promote the local legislation of sports tourism,so as to build a systematic industrial legal system.
