随着大数据时代的到来,大数据对于政府依法行政的重要性日益凸显.运用大数据推进依法行政,有利于行政决策的科学化和民主化,有利于监督和制约行政权的滥用,有利于提高行政效益,能够更加有效地预防官员腐败,有助于行政执法模式的转型.但政府运用大数据推进依法行政也面临着政府官员和行政执法人员缺乏大数据思维、政府大数据开放共享不到位、政府大数据执法侵犯当事人权利等挑战.针对这些挑战,可以从树立政府人员大数据思维意识、开放与共享政府数据资源、加强对政府数据执法行为的监督和评估等方面着手力促行政机关依法行政,如期建成法治政府.

With the advent of the era of big data,big data is increasingly important for the government’s administration according to law.The use of big data to promote administration according to law is conducive to the scientific and democratization of administrative decision-making,conducive to supervising and restricting the abuse of administrative power,improving administrative efficiency,preventing official corruption more effectively,and facilitating the transformation of administrative law enforcement models.However,the government’s use of big data to promote legal administration also faces the lack of big data thinking consciousness among government officials and administrative law enforcement personnel,lack of open and shared government big data,lack of professional big data technology talent,government big data law enforcement infringing the rights of parties,and so on.In view of these challenges,it is possible to force Executive agency to administer according to law and build a government under the rule of law on schedule by establishing government personnel’s big data thinking consciousness,opening and sharing government data resources,and and strengthening the supervision and evaluation of government data law enforcement behaviors,and so on.
